The terms that apply when you access and use the MiMA Forklift Thailand website.

These Terms of Use govern your access to and use of the website operated by MiMA Forklift Thailand Co., Ltd.
Please read them carefully before using mima.co.th. They apply to the website only and do not replace the separate terms contained in a quotation, purchase order, distribution agreement, service agreement, warranty document or other contract.
01Agreement to These Terms
The website is operated by MiMA Forklift Thailand Co., Ltd. ("MiMA Thailand", "we", "us" or "our"). By accessing or using the website, you confirm that you have read and agree to these Terms of Use. If you do not agree, please stop using the website.
Additional terms may apply to a particular feature, event, download, promotion or service. If those additional terms conflict with these Terms of Use, the more specific terms apply to that feature or activity.
02About the Website
The website provides general information about MiMA electric material-handling equipment, applications, projects, events and support in Thailand. It also allows users to request information, quotations, meetings, showroom visits, product recommendations and other business contact.
The website is primarily informational. Unless we clearly state otherwise, it is not an e-commerce platform and does not itself complete an equipment purchase, rental, service order, dealership appointment or other binding commercial transaction.
MiMA Thailand is the local business and showroom operation in Thailand. Manufacturing and certain engineering, quotation, configuration or support activities may involve MiMA group companies and facilities outside Thailand.
03Eligibility and Authority
The website is intended mainly for business and professional users. If you use it on behalf of a company or another organisation, you confirm that you have authority to provide information and communicate with us for that organisation.
You must not use the website if doing so would violate applicable law, a legal restriction or an obligation you owe to another person. Nothing in these terms limits any mandatory rights available to an individual consumer under applicable law.
04Enquiries, Quotations and Commercial Contracts
A form submission, email, telephone call, LINE message, meeting request, brochure download or other website interaction is an enquiry only. It does not create a contract, reserve equipment, confirm availability, appoint a dealer or obligate us to accept an order.
A quotation or proposal is binding only to the extent expressly stated in that document and remains subject to its validity period, assumptions, exclusions and approval conditions. Any purchase, supply, service, warranty, dealer or other commercial relationship is governed by the agreement accepted by the relevant parties.
Contract priority: if website content conflicts with a signed agreement, accepted quotation, confirmed purchase order, product-specific warranty or other formal commercial document, that formal document takes priority for the relevant transaction.
05Product Information, Specifications and Availability
Product photographs, drawings, dimensions, capacities, lift heights, aisle requirements, performance figures, battery data, features, certifications, options and application examples are provided for general guidance. Actual performance and suitability depend on the selected configuration, load, mast, attachment, battery, tyre, operating environment, floor, racking, duty cycle, local standards and other project conditions.
We aim to keep website information accurate, but product development and local availability may change without prior notice. Images may show optional equipment or a configuration not supplied as standard. Colours and proportions may appear differently on different devices.
You should obtain a written, project-specific recommendation and confirm all critical specifications before ordering, altering a warehouse, installing racking or relying on a stated capability. Website information is not a substitute for a site survey, risk assessment, operator training, maintenance instruction or the official operating manual.
06Acceptable Use
You may use the website for lawful information and business-enquiry purposes. You must not:
- use the website in a way that violates law, infringes rights or facilitates fraud, abuse or harmful activity;
- attempt to gain unauthorised access to the website, server, accounts, source systems or connected networks;
- introduce malware, malicious code, automated spam, excessive requests or any technology intended to disrupt or damage the website;
- scrape, harvest or extract content or personal data at scale without our prior written permission, except where applicable law clearly permits it;
- circumvent security, access controls, rate limits, robots instructions or technical restrictions;
- misrepresent your identity, company, authority, project or relationship with MiMA;
- use website content to create misleading product claims, counterfeit materials or an unauthorised impression of endorsement; or
- use contact details published on the website for unsolicited bulk messaging or unlawful marketing.
We may investigate suspected misuse and cooperate with service providers or authorities where reasonably necessary and legally permitted.
07Intellectual Property
Unless otherwise stated, the website and its text, photographs, videos, graphics, layouts, downloads, product names, logos, trademarks, design elements and software are owned by or licensed to MiMA Thailand, MiMA group companies or their respective licensors and are protected by applicable intellectual-property laws.
You may view the website and download or print a reasonable number of pages for your own internal, non-commercial evaluation of MiMA products. You must not reproduce, modify, publish, distribute, sell, licence, translate, remove notices from or create derivative commercial materials from website content without prior written permission from the relevant rights holder.
No licence or right to use a MiMA name, logo, product image, trademark, design, patent, technical drawing or other intellectual property is granted except for the limited website access expressly described in these terms.
08Information and Materials You Submit
You are responsible for ensuring that information and materials you send to us are accurate, lawful and relevant and that you have the right and authority to provide them. This may include names, business contact details, site photographs, warehouse layouts, drawings, load information, specifications, logos or other project files.
You grant MiMA Thailand and the MiMA personnel, group companies and project partners involved in your request a limited right to access, copy, translate, adapt and use submitted materials only as reasonably necessary to review the enquiry, communicate with you, prepare a solution or quotation, perform an agreed project or comply with law. You retain ownership of your materials.
Website forms and ordinary email are not designed for highly sensitive trade secrets or security-critical information. Unless a separate confidentiality agreement or other duty already applies, submitting information through the website does not by itself create a confidentiality agreement. Contact us before sending material that requires special handling.
09Third-Party Links and Services
The website may link to or embed services operated by third parties, such as LINE, YouTube, LinkedIn, maps, file platforms, event organisers, dealers or other websites. A link is provided for convenience and does not by itself mean that we control, approve or guarantee the third party or its content.
Third-party services have their own terms, privacy notices and security practices. You use them at your own discretion. We are not responsible for third-party websites or for loss caused by content, availability or conduct outside our reasonable control, to the extent permitted by law.
References to a dealer, distributor, service partner or integrator do not authorise that party to make promises or representations on behalf of MiMA Thailand unless a written agreement expressly grants that authority.
10Privacy and Cookies
Our Privacy Notice explains how we collect, use, disclose, retain and protect personal data. Our Cookie Policy explains the website technologies we use and how you can manage non-essential categories.
By submitting information, you confirm that you have read the relevant privacy information. If you provide personal data about another individual, you should ensure that you are authorised to do so and that the individual has received any information required by law.
11Website Availability and Disclaimers
We aim to provide a useful and secure website, but the website is provided on an "as available" basis. To the maximum extent permitted by law, we do not promise that it will always be uninterrupted, error-free, current, compatible with every device or free from harmful components.
General articles, application examples, calculators, FAQs and other educational content do not constitute engineering, safety, financial or legal advice. You remain responsible for professional assessment, compliance with local standards and safe selection, installation, operation and maintenance of equipment.
Nothing in this section excludes a product warranty or other obligation expressly accepted in a separate binding agreement, or any warranty or right that cannot lawfully be excluded.
12Limitation of Liability
To the maximum extent permitted by applicable law, MiMA Thailand and its directors, employees, affiliates and service providers will not be liable for indirect, incidental, special, exemplary or consequential loss arising only from access to or reliance on the general website, including loss of profit, revenue, opportunity, goodwill or data.
We are not responsible for loss caused by matters outside our reasonable control, third-party services, unauthorised website use or reliance on information that should reasonably have been confirmed in a project-specific document.
Nothing in these terms limits or excludes liability for fraud, wilful misconduct, death or personal injury caused by negligence, or any other liability that cannot be limited or excluded under applicable law. Liability relating to an actual product, order or service is governed by the relevant binding commercial agreement and mandatory law.
13Changes, Suspension and Termination
We may update, correct, replace, suspend or withdraw any part of the website without prior notice where reasonably necessary for maintenance, security, legal compliance, business changes or product updates.
We may restrict or terminate access by a user who violates these terms, threatens website security, infringes rights or uses the website unlawfully. Provisions that by their nature should continue - including intellectual property, disclaimers, liability, governing law and rights relating to submitted materials - survive termination.
We may revise these Terms of Use from time to time. The latest version will be published on this page with the updated date. Continued use after publication means the revised terms apply from that point, subject to any notice required by law.
14Governing Law and General Provisions
These Terms of Use and any non-contractual dispute arising from the website are governed by the laws of the Kingdom of Thailand, without regard to conflict-of-law principles. Subject to any mandatory rights or dispute forum that cannot lawfully be excluded, the courts of Thailand have exclusive jurisdiction.
If a provision is found invalid or unenforceable, it will be adjusted or removed only to the minimum extent necessary, and the remaining provisions will continue. A failure to enforce a provision is not a waiver. You may not assign rights under these terms without our prior written consent; we may assign them as part of a lawful reorganisation, business transfer or transfer of website operations.
These terms, together with any additional website terms expressly incorporated into them, form the agreement governing use of the website. They do not amend a separate commercial contract between you and a MiMA entity.
